This is an academic philosophy lecture presenting H.J. McCloskey’s famous Sheriff counterexample to utilitarianism, along with J.J.C. Smart’s defense. It’s not a debate — it’s a clear summary of one of the most important arguments in moral philosophy. The vault’s framework has already rejected utilitarianism, but this lecture provides the cleanest setup for articulating why.
Utilitarianism = three sub-theses combined:
McCloskey’s Sheriff example: A crime has been committed. A mob is convinced they know who did it. They’re wrong — the suspect is innocent. The sheriff knows this but can’t convince the mob. If the mob doesn’t get “justice,” they’ll riot, and hundreds of innocent people will die. The sheriff can prevent the riot by framing and executing the one innocent suspect.
The utilitarian calculation: One innocent person dies (framed) vs. hundreds of innocent people die (riot). The math is clear — frame the innocent man. Utilitarianism says the sheriff is morally required to do this.
McCloskey’s objection: But framing an innocent person is profoundly wrong. Any moral theory that says otherwise is not the right theory. This is a counterexample — one case where the theory produces a result so obviously wrong that the theory itself is disproven.
Smart’s defense: He tries two moves:

McCloskey and Smart are both arguing within the utilitarian framework — one says it produces bad results, the other says those results are actually correct. But the vault rejects utilitarianism on first principles, before the Sheriff scenario ever arises.
Utilitarianism requires adding up pleasure and pain across different people. But interpersonal utility comparison is impossible. There is no “group utility.” Utility is ordinal (I prefer A to B), not cardinal (A gives me 7 utils, B gives me 3 utils). You cannot sum ordinal preferences across individuals. The aggregation step isn’t wrong because it produces bad results in edge cases — it’s meaningless. It’s not even wrong. It’s like asking “what is the sum of purple and Wednesday?”
The Sheriff scenario presupposes that “one death vs. hundreds of deaths” is a calculable comparison. It isn’t. There is no common unit in which to express “the pain of the innocent man being framed” and “the pain of hundreds of riot victims” such that one can be subtracted from the other. These are incommensurable experiences belonging to separate conscious agents. The “math” that utilitarianism performs is not math — it’s a subjective weighting function disguised as arithmetic.
This is the weighting problem at its most fundamental: objective measurements (number of deaths) do not produce objective composite judgments (which outcome is “better”) without a subjective aggregation function. And that aggregation function is where all the moral assumptions hide.
Make them do the math. The way to crack a utilitarian is not to argue theory — it’s to make them actually perform the operation they claim is possible. Person A experiences 5 seconds of ecstasy. Person B experiences 10 seconds of discomfort. Add them. What’s the answer? In what units? The moment they assign numbers (“ecstasy is +8, discomfort is -3”), ask: where did those numbers come from? The answer is always their own subjective judgment. The aggregation function doesn’t produce objective results — it launders subjective weightings through arithmetic notation.
The time problem breaks it further. Was an ancient Roman farmer with a full belly and a loving family less happy than a modern American below the poverty line with a smartphone and air conditioning? The utilitarian has to say yes (more material comfort = more utility) or no (utility is relative to expectations and context). If yes, then utility isn’t about subjective experience at all — it’s about material conditions, which abandons hedonism. If no, then utility is relative to context, which means it can’t be compared across people or times, which kills aggregation. Either answer destroys the framework.
The market alternative: Markets don’t solve the aggregation problem — they dissolve it. Prices are information signals that emerge from individual choices. Nobody calculates “group utility” because the market allows each person to act on their own preferences. The outcome isn’t declared “correct” by some external calculation — it’s the emergent result of free choice. Markets create alternatives; they don’t judge that this outcome is the right one. Utilitarianism tries to do what markets know is impossible: centrally compute the optimal allocation of outcomes across individuals.
The Sheriff problem never arises in this framework because you never get to the calculation. There’s no math that says “one death < hundreds of deaths” in a morally actionable sense. The sheriff is just a man deciding whether to frame an innocent person — and “don’t punish the innocent” is a durable heuristic that exists independently of any aggregate calculation.
Even granting the utilitarian framework for the sake of argument, three additional structural problems emerge:
Utilitarianism operates at the wrong scope. It treats individual rights as expendable variables in a collective optimization problem. But the vault’s morality framework grounds morality in individual consciousness and agency — these are the prerequisites for morality to exist at all. An individual’s right not to be framed for a crime they didn’t commit isn’t a number to be weighed against other numbers. It’s a feature of the moral landscape itself.
The sheriff framing the innocent man isn’t “one unit of injustice” to be weighed against “hundreds of units of prevented suffering.” It’s a categorical violation — the sheriff is using his authority to do the opposite of what that authority exists to do. The scope confusion here: utilitarianism treats the individual scope (rights, justice) as subordinate to the aggregate scope (total outcomes), but the individual scope is where morality lives. Without individual conscious agents, there is no pleasure or pain to aggregate in the first place.
The sheriff’s authority derives from the justice system. The justice system’s legitimacy depends on the presumption that it punishes the guilty and protects the innocent. When the sheriff frames an innocent person, he’s using the authority granted by the system to undermine the basis of the system. This is a performative contradiction — the act destroys the foundation that makes the act possible.
This is the same structure as “why ought I exist?” being self-defeating — the sheriff’s action presupposes institutional legitimacy while destroying it. Smart’s “bite the bullet” response ignores this: you can’t coherently say “the justice system requires me to subvert the justice system.”
Even if the sheriff gets away with it — even if no one ever discovers the framing — the opposing forces principle predicts systemic consequences. A justice system that would frame an innocent person if the math worked out is a different system than one that would not, even if no specific instance is ever detected.
Institutions encode their principles in their behavior patterns. A sheriff who frames one innocent person has established (at minimum within himself) that innocents are expendable when the numbers are right. This changes future decisions, erodes institutional integrity from within, and — at scale — produces exactly the kind of system that citizens should riot against. The utilitarian calculation that justifies the framing also justifies every future framing where the numbers “work out.” The precedent is the problem, not the individual case.
Smart’s “bite the bullet” is actually worse than McCloskey realizes. Smart isn’t just saying “this one framing is justified.” He’s saying “any framing is justified whenever the aggregate math works out.” That’s not a bullet to bite — that’s a principle that destroys the possibility of justice.
The Sheriff example exposes something beyond aggregation. Utilitarianism can’t answer the question “why should I maximize aggregate utility?” without either:
The vault’s framework avoids this problem because it doesn’t start from a principle about what to maximize. It starts from brute “is” facts (you exist, you’re conscious, you must act, reality has causal structure) and derives moral reasoning as probabilistic tendencies observable in aggregate data. The individual chooses freely; the data shows which choices tend toward which outcomes. At no point does the framework say “sacrifice this individual for that aggregate.” The individual is the unit of moral analysis, not a variable in a collective equation.
McCloskey’s intuition — “framing an innocent person is wrong regardless of consequences” — is actually tracking something real, even though he can’t articulate why it’s wrong beyond “it feels wrong.”
The vault can articulate it: cross-cultural moral convergence shows that “don’t punish the innocent” is one of the most stable heuristics across civilizations. Independent societies converge on this principle because societies that routinely sacrifice innocents for collective benefit are unstable — people can’t trust institutions, which undermines the cooperation that makes institutions work. The heuristic persists because it tracks a real probabilistic tendency: societies that protect the innocent outperform societies that don’t, across every measurable axis, over civilizational timescales.
McCloskey’s intuition is the leading indicator. The civilizational data is the lagging indicator that confirms it. You don’t need to call it “intuition” — it’s pattern recognition built on millennia of observation.
Utilitarianism fails at the foundation, not at the edge cases. The Sheriff problem attacks utilitarianism from within — “your math produces bad answers.” The vault rejects it before the math starts: interpersonal utility comparison is impossible. There is no group utility. The aggregation step is meaningless, not merely flawed. Markets prove this — they dissolve the aggregation problem by enabling individual choice rather than computing collective optima.
The Sheriff problem is just a trolley problem for law enforcement. It presupposes the utilitarian framework (there exists a calculable tradeoff between lives) and then asks whether you accept the result. But the presupposition is false. There is no calculation. There are individual agents with individual rights, and “don’t punish the innocent” is a heuristic that exists independently of any aggregate math.
“Bite the bullet” is a concession, not a defense. Smart commits to “any framing is justified when the numbers work,” which is a principle that destroys justice as a concept. The bullet he’s biting is loaded.
The vault handles this without intuition. McCloskey needs moral intuition to reject the framing. The vault doesn’t — it rejects the framework at the foundational level (no group utility) and has three additional structural arguments (scope error, performative contradiction, opposing forces) none of which depend on “it feels wrong.”
“Don’t punish the innocent” is one of the most durable moral heuristics in human history. Its cross-cultural convergence is evidence that it tracks real structural features of how societies function, not just shared sentiment. It doesn’t need utilitarian math to justify it — the aggregate data across civilizations already shows that societies protecting the innocent outperform those that don’t.
